Ohio Environmental Protection Agency Issues Covenant Not to Sue for Abandoned Hospital Site - 
State Action Confirms Property is Clear of Environmental Contaminants
The Ohio Environmental Protection Agency has issued a Covenant Not to Sue to the City of Piqua for the former Piqua Memorial Hospital property. The property is cleaned of environmental contaminants and is suitable for development; the land will be the home of the Piqua City School's newest intermediate school, currently under construction.

"The City worked very hard to secure over $2.2 million in grant dollars to investigate contaminants and to remediate and demolish the property. Our community is grateful to the State of Ohio for their generous support of this project, along with the consultant, Burgess and Niple, Inc. and contractor, Evans Landscaping, Inc. All of which played critical roles in making this project successful. The City is very pleased that this land can be brought to productive reuse as a new school," said William Lutz, Development Program Manager.

A covenant not to sue protects the property's owners or operators and future owners from being legally responsible to the State of Ohio for further environmental investigation and remediation relating to known releases. This protection applies only when the property is used and maintained in accordance with the terms and conditions of the covenant.

In the 18 years since Ohio EPA issued the first covenant under VAP, more than 8,000 acres of blighted land have been revitalized at nearly 400 sites across the state.
