Piqua City Commission met at 7:30 P.M. in
the Municipal Government Complex Commission Chambers located at 201 W.
Water Street. Mayor Hudson called the meeting to order. Also present
were Commissioners Barhorst, Vogt, Patrizio and Terry. Absent: None. REGULAR CITY COMMISSION MEETING APPROVAL OF MINUTES Moved by Commissioner Terry, seconded by Commissioner Barhorst, that the minutes of the Regular City Commission Meeting of December 3, 2007 be approved. Voice vote, Aye: Terry, Barhorst, Vogt, Hudson, and Patrizio. Nay: None. Motion carried unanimously. ORD. NO. 27-07 (3rd READING) An Ordinance amending Section 91.23 of the Piqua Code relating to Definitions Commissioner Patrizio read a statement on the various ordinances on the agenda, and the recent story that appeared on Channel 22 regarding the code enforcement policies of the City of Piqua. Chuck Starrett, P.O.I.N.T. Director voiced his opinion on the code enforcement requirements and the fines that are to be levied for property maintenance. Roy Howard voiced his opinion on the ordinances and the enforcement of the fines. Commissioner's Patrizio and Barhorst tried to explain the reason for the code enforcement requirements and fines. Almeda Nash, 920 Linden Avenue, voiced her concern over a property next to her that is in need of repair. Mrs. Nash also stated she had received a property maintenance notice on a property she owned in Shawnee but she was able to have it painted as requested. Several other citizens voiced concerns over the code enforcement requirements and several properties owned by the City of Piqua. Law Director Stacy Wall explained the reason the 'vacant properties" owned by the City of Piqua have not been repaired. Jim Myers thanked City Manager Enderle, Commissioner Vogt and Commissioner Barhorst for meeting with him. Mr. Myers stated he felt he was able to air out some the problems and voiced his opinion on several other issues. Moved by Commissioner Terry, seconded by Commissioner Barhorst, that Ordinance No. 27-07 be adopted. Roll call, Aye: Vogt, Hudson, Patrizio, Terry, and Barhorst. Nay: None. Motion carried unanimously. Mayor Hudson then declared Ordinance No. 27-07 adopted. ORD. NO. 28-07 (3rd READING) An Ordinance amending Chapter 150 (Appendix: Tables, Table A: Permit Fee Schedule) Jim Myers voiced his opinion on the inspection fees. Tony Chappie voiced his concern about letters being sent only to the property owners and would like to see them sent to the tenants also. Mr. Chappie also complimented the Commission on enforcing and applying fines for code violations. City Manager Enderle explained how the violation notices are being sent out and why they are only being sent to property owners. Moved by Commissioner Patrizio, seconded by Commissioner Terry, that Ordinance No. 28-07 be adopted. Roll call, Aye: Terry, Hudson, Patrizio, Vogt and Barhorst. Nay: None. Motion carried unanimously. Mayor Hudson then declared Ordinance No. 28-07 adopted. ORD. NO. 29-07 (3rd READING) An Ordinance amending Section 91.36 of the Piqua Code relating to Definitions Moved by Commissioner Patrizio, seconded by Commissioner Terry, that Ordinance No. 29-07 be adopted. Roll call, Aye: Barhorst, Terry, Hudson, Patrizio, and Barhorst. Nay: None. Motion carried unanimously. Mayor Hudson then declared Ordinance No. 29-07 adopted. ORD. NO. 30-07 (3rd READING) An Ordinance amending Chapter 154 of the Piqua Municipal Code establishing the discontinuance of a nonconforming use and the discontinuance of a nonstandard use Moved by Commissioner Patrizio, seconded by Commissioner Barhorst, that Ordinance No. 30-07 be adopted. Roll call, Aye: Vogt, Barhorst, Terry, Hudson and Patrizio. Nay: None. Motion carried unanimously. Mayor Hudson then declared Ordinance No. 30-07 adopted. ORD. NO. 31-07 (3rd READING) An Ordinance adopting and implementing procedures under Ohio Revised Code Chapter 5722 to facilitate the effective reutilization of nonproductive land situated within the City of Piqua, which program shall be known as the Piqua Land Reutilization Program Moved by Commissioner Patrizio, seconded by Commissioner Terry, that Ordinance No. 31-07 be adopted. Roll call, Aye: Patrizio, Vogt, Barhorst, Terry, and Hudson. Nay: None. Motion carried unanimously. Mayor Hudson then declared Ordinance No. 31-07 be adopted. ORD NO. 32-07 (3rd READING) An Emergency Ordinance adopting and implementing a Civil Code for nuisance violations (Chapter 91), Zoning Code Violations (Chapter 154), and Property Maintenance Violations (Chapter 150) of the Piqua Municipal Code Chuck Starrett voiced his opinion over several issues with the Civil Code and the fees being applied. Law Director Wall explained how the fees are applied. John Martin asked how Ordinance No. 27-07 and Ordinance No. 32-07 are enforced. Law Director Wall explained the procedure. There was discussion on who is responsible for enforcing the tenants to keep the properties cleaned up and mowed. City Manager Enderle stated the city is willing to work with landlords to help them, but the city is not willing to do the job for the landlords. Moved by Commissioner Patrizio, seconded by Commissioner Terry, that Ordinance No. 32-07 be adopted. Voice vote: Aye: Hudson, Patrizio, Vogt, Barhorst, and Terry. Nay: None. Motion carried unanimously. Mayor Hudson then declared Ordinance No. 32-07 adopted. ORD NO. 33-07 (Amended) An Ordinance to make Appropriation for the City of Piqua, Ohio for the year 2008 Moved by Commissioner Terry, seconded by Commissioner Vogt, that Ordinance No. 33-07 be adopted. Roll call, Aye: Terry, Hudson, Patrizio, Vogt, and Barhorst. Nay: None. Motion carried unanimously. Mayor Hudson then declared Ordinance No. 33-07 adopted. ORD. NO. 35-07 (Third Reading) An Ordinance amending Section 31.21 of the Piqua Code relating to the Civil Service Department Moved by Commissioner Patrizio, seconded by Commissioner Vogt, that Ordinance No. 35-07 be adopted. Voice vote, Aye: Hudson, Vogt, Patrizio, Terry, and Barhorst. Nay: None. Motion carried unanimously. Mayor Hudson then declared Ordinance No. 35-07 adopted. ORD. NO. 37-07 (1st READING) An Ordinance to make appropriations for the City of Piqua, Ohio for the year 2007 Moved by Commissioner Patrizio, seconded by Commissioner Terry, that the rule requiring Ordinance No. 37-07 be read fully and distinctly on three separate days be suspended. Voice vote, Aye: Patrizio, Hudson, Vogt, Terry, and Barhorst. Nay: None. Motion carried unanimously. R-129-07 A Resolution authorizing a purchase order to Francis Office Supply, Inc. for various office products Moved by Commissioner Patrizio, seconded by Commissioner Barhorst, that Resolution No. R-129-07 be adopted. Roll call, Aye: Hudson, Patrizio, Vogt, Barhorst, and Terry. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-129-07 adopted. RES. NO. R-130-07 A Resolution authorizing temporary advances from the General Fund to other funds for the Fiscal Year 2008 City Manager Enderle explained the reason for this resolution. Moved by Commissioner Vogt, seconded by Commissioner Terry, that Resolution No R-130-07 be adopted. Voice vote, Aye: Vogt, Patrizio, Barhorst, Hudson, and Terry. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-130-07 adopted. RES. NO. Voice Vote, Aye: Terry, Hudson, Barhorst, Patrizio and Vogt. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-132-07 adopted. RES. NO. R-133-07 A Resolution of Intent to vacate public-right-of-way Moved by Commissioner Barhorst, seconded by Commissioner Terry, that Resolution No. R-133-07 be adopted. Voice vote, Aye: Terry, Hudson, Patrizio, Vogt, and Barhorst. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-133-07 adopted. RES. NO. R-134-07 A Resolution amending the total payment to Fanning/Howey Associates, Inc. for the East Ash Street reconstruction project Several questions were asked on the reconstruction project, and how it was going to affect the various properties located on East Ash Street. Moved by Commissioner Patrizio, seconded by Commissioner Terry, that Resolution No. R-134-07 be adopted. Roll call, Aye: Hudson, Patrizio, Vogt, Barhorst, and Terry. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-134-07 adopted. OTHER 2008 Commission Study Sessions - City Manager Fred Enderle City Manager Enderle stated the City Commission would hold several Commission Study Sessions in 2008. January 14, 2008 Commission Goal Review Several citizens asked questions and voiced opinions on various issues. Commission and staff answered their questions. Commissioner Vogt stated citizens should contact the City offices if they have any questions or receive violation notices and need more time to complete the repairs. The city is willing to work with citizens they just have to call and ask for help, said Commissioner Vogt. Commissioner Patrizio thanked the City Manager, City Commissioners, City employees, the citizens of Piqua, and his family for all their support the past four years of his term as Fifth Ward Commissioner. Commissioner Terry responded to a story that appeared on Channel 22 concerning the various problems the P.O.I.N.T. group feels is the direct result of the City of Piqua stepping up the property maintenance code. Commissioner Terry thanked Commissioner Barhorst and Commissioner Patrizio for their service to the City of Piqua, and wished then well in the future. City Manager Enderle thanked Commissioner Patrizio and Commissioner Barhorst and wished them well. Mr. Enderle stated it was a great pleasure working with both of them and appreciates all their support they provided over the years. Mayor Hudson thanked Commissioner Barhorst for his twenty-years of service to the City of Piqua, and stated he appreciated Commissioner Patrizio's input and wished them good luck. Commissioner Barhorst thanked all the City Commissioners, and his wife for their support over the past twenty-years he has served the City of Piqua as Commissioner and Mayor. Commissioner Barhorst thanked city staff for their support, and stated he felt he was leaving the City in good hands. Moved by Commissioner Vogt, seconded by
