Piqua City Commission met in Special Work
Session at 4:00 P.M. in the Municipal Government Complex Administrative
Conference Room, 201 W. Water Street. Mayor Hudson called the meeting to
order at 4:00 P.M. Also present were Commissioners Barhorst, Terry, and
Vogt. Absent: Commissioner Patrizio. Also in attendance: City Manager
Fred Enderle, Planning & Zoning Supervisor Chris Schmiesing and, Law
Director Stacy Wall.
It was moved by Commissioner Vogt, and seconded by Commissioner Terry, to excuse Commissioner Patrizio from the Piqua City Commission Work Session of September 13, 2007. Voice vote, Aye: Vogt, Hudson, Terry, and Barhorst. Nay: None. Motion carried unanimously. Discussion of Tabled Ordinance No. 14-07 An Ordinance amending Section 154,005 of the Piqua Code relating to (Definitions) and 154.081 of the Piqua Code relating to (General Regulations) City Manager Enderle explained the reason for the work session, and stated some of the questions that have come up in light of this ordinance. Commissioner Vogt stated he is still concerned about the wording in the "Major Repairs" section. City Manager Enderle explained the information in the section is just examples, and they are just tools available for enforcement of the ordinance. These are not set in stone rules, just examples, said Mr. Enderle. City Manager Enderle asked Ms. Wall to look at the wording and rewrite it to state examples. Commissioner Vogt stated maybe the wording could say "Routine Maintenance" instead of "Major Repairs." Ms. Wall explained some of the case laws that have gone to court on "Routine Maintenance" issues. Ms. Wall stated by changing the wording it could resolve some of the concerns of the use of "Routine Maintenance" and we can add stipulations. City Manager Enderle asked why do we need the "Major Repair" section in the code? Chris Schmiesing explained the reason for the "Major Repair" section being in the code. City Manager Enderle stated he would like Ms. Wall to work on the language and send the revisions out for all to review. Commissioner Vogt stated he was satisfied with this solution at this time, but voiced his concerns over the Junk Car Ordinance also. Ms. Wall explained a current case law on trial at this time on "Junk and Operational Abandoned" vehicles. City Manager Enderle stated these codes are standard in most communities, and are in place to have available when needed. Commissioner Vogt voiced his concerns about stone & gravel driveways, and the need for curbing in certain areas of the city. Mr. Schmiesing explained the use of gravel in side and rear yards, and further explained the need to change other regulations in the Parking Code Section at this time. City Manager Enderle explained the need
for some adjustments to the code sections and how Several questions were asked concerning the use of barrier blocks and the need for them in parking areas. Mr. Schmiesing explained the need for barrier blocks and how they are used in various areas of the city in parking lots and etc. Moved by Commissioner Vogt, seconded by
Commissioner Terry, to adjourn from the Piqua City Commission Work
Session at 4:30 P.M. Voice vote, Aye: Hudson, Vogt, and Barhorst. Nay:
