Piqua City Commission met at 7:30 P.M. in the Municipal Government Complex Commission Chambers located at 201 W. Water Street. Mayor Hudson called the meeting to order. Also present were Commissioners Vogt, Patrizio, Barhorst, and Terry. Absent: None.

OATH OF OFFICE - PIQUA LAW DIRECTOR - STACY M. WALL

Current Law Director Grant D. Kerber administered the Oath of Office of Law Director for the City of Piqua to Stacy M. Wall

PRESENTATION OF RESOLUTION NO. R-83-07

Mayor Hudson read Resolution No. R-83-07 a resolution of appreciation for the public service of Grant D. Kerber as Law Director for the City of Piqua, and presented the Resolution to Mr. Kerber.

Moved by Commissioner Terry, seconded by Commissioner Vogt, that Resolution No. R-83-07 be adopted. Voice vote, Aye: Hudson, Patrizio, Terry, Vogt, and Barhorst. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-83-07 adopted.

HOTEL PRESENTATION - Mr. Jeff Wray of Jeff Wray Architects

Mr. Wray gave a brief power point presentation on the work being done on the Hotel Project. The Hotel is in various stages of restoration at this time and Mr. Wray stated they are about 25% through the project. Mr. Wray stated he would be giving quarterly reports on the work being done on the Hotel Project in the future.

REGULAR CITY COMMISSION MEETING

APPROVAL OF MINUTES

Moved by Commissioner Terry, seconded by Commissioner Vogt, that the minutes of the Regular City Commission Meeting on June 4, and the Special City Commission Work Session held on June 7, 2007 be approved as written. Voice vote, Aye: Barhorst, Vogt, Patrizio, Terry, and Hudson. Nay: None. Motion carried unanimously.

ORD. NO. 7-07 - Tabled
(3rd Reading)

An Ordinance amending Section 76.16 of the Piqua Code relating to (Parking prohibited in certain areas) and Section 76.99 of the Piqua Code relating to (Penalty)

Moved by Commissioner Barhorst, seconded by Commissioner Terry, to remove Ordinance No. 7-07 from the table. Voice vote, Aye: Vogt, Patrizio, Hudson, Terry, and Barhorst. Nay: None. Motion carried unanimously to remove Ordinance No. 7-07 from the table.

Commissioner Vogt stated he was concerned about the verbage in Section A # 2- Commercial Car or Truck. Commissioner Vogt would like to strike out Section A # 2 as it reads.

Police Chief Willcox explained the definition of a commercial car or truck.

Moved by Commissioner Vogt, seconded by Commissioner Patrizio, to strike out Section A # 2 - Commercial Car or Truck in 76.16 Parking Prohibited in Certain Areas. Voice vote, Aye: Patrizio, Hudson, Barhorst, Terry, and Vogt. Nay: None. Motion carried unanimously.

Moved by Commissioner Patrizio, seconded by Commissioner Vogt, to adopt the amended Ordinance No. 7-07 as delivered to the Commission at the June 18, 2007 Piqua City Commission Meeting. Voice vote, Aye: Patrizio, Vogt, Hudson, Terry, and Barhorst. Nay: None. Motion carried unanimously.

Commissioner Patrizio stated he had received a telephone call concerning the amount of time a vehicle can be left running unattended.

Police Chief Willcox explained there is a City Ordinance concerning an unattended vehicle running at any time.

Mayor Hudson thanked Police Chief Willcox for putting together several meetings with the public on the truck parking issue.

Chuck Starrett, Demming Road, voiced his concern about the parking of vehicles in alleys and parking recreational vehicles on their property, and asked what is an approved surface.

City Manager Enderle explained the description of an approved surface.

Mr. Starrett also voiced his concern over the parking of trucks on the streets.

Bill Schlosser, Piqua resident, voiced his concern about parking boats and trailers in yards. He stated he was ordered to remove his, but others still have theirs in their yards.

City Manager Enderle explained the city's standpoint and stated they will have the others removed if they are illegally parked.

Mr. Schlosser stated there are some city properties that are not in compliance, such as behind the Water Plant and at Pitsenbarger Park. Mr. Schlosser stated he would like to hear comments from each of the Commissioners on what their feelings are on parking vehicles in yards.

Commissioner Patrizio tried to explain the reason behind the ordinance.

Steve Stiefel, Brentwood Avenue, voiced his concern about the setbacks behind garages or in backyards.

City Manager Enderle explained how the setbacks would apply to the ordinance.

Mr. Stiefel would like to have the seventy-two hour restriction removed on parking.

City Manager Enderle stated there is no parking of semis on the street allowed at any time, and parking of RV's and other vehicles on the street is just for the purpose of loading and unloading.

Chet Osborne, Staunton Street, voiced his concern over trucks parking in driveways.

City Manager Enderle stated the trucks would have to fit in the driveway.

Mr. Osborne asked how they defined the setbacks on the properties.

City Manager Enderle explained.

Roy Howard, Spiker Road, voiced his concern about having a construction trailer on the street for any length of time.

City Manager Enderle explained that construction trailers come in the morning and leave at night, and are not parked there continuously.

Moved by Commissioner Terry, seconded by Commissioner Barhorst, that Ordinance No. 7-07 be adopted. Voice vote, Aye: Hudson, Patrizio, Vogt, Terry, and Barhorst. Nay: None. Motion carried unanimously. Mayor Hudson then declared Ordinance No. 7-07 adopted.

RES. NO. R- 79-07

A Resolution authorizing the City Manager to make application to the National Park Service for funding through the "Preserve America" program

Moved by Commissioner Barhorst, seconded by Commissioner Vogt, that Resolution No. R-79-07 be
adopted. Voice vote, Aye: Barhorst, Terry, Hudson, Patrizio, and Vogt. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-79-07 adopted.

RES. NO. R-80-07

A Resolution approving the Fiscal-Year 2007 Formula Allocation program application

Moved by Commissioner Patrizio, seconded by Commissioner Vogt, that Resolution N. R-80-07 be adopted. Voice vote, Aye: Hudson, Terry, Patrizio, Vogt, and Barhorst. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-80-07 adopted.

RES. NO. R-81-07

A Resolution authorizing the City Manager to enter into a lease agreement to permit the usage of a portion of Fountain Park, Hardman Field, and Hance Pavilion to the Piqua Fourth of July Association

Moved by Commissioner Patrizio, seconded by Commissioner Barhorst, that Resolution No. R-81-07 be adopted. Voice vote, Aye: Patrizio, Hudson, Vogt, Barhorst, and Terry. Nay: None. Mayor Hudson then declared Resolution No. R-81-07 adopted.

A Resolution accepting for statutory purposes a budget for the calendar year 2008

Moved by Commissioner Patrizio, seconded by Commissioner Terry, that Resolution No. R-82-07 be adopted. Voice vote, Aye: Terry, Barhorst, Patrizio, Hudson, and Vogt. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-82-07 adopted.

RES. NO. R-84-07

A Resolution of Appreciation for the Public Service of James A. Eberly as a City Employee

Commissioner Barhorst thanked Mr. Eberly for his 30 years of service to the City of Piqua.

Moved by Commissioner Patrizio, seconded by Commissioner Barhorst, that Resolution No. R-84-07 be adopted. Voice vote, Aye: Terry, Hudson, Patrizio, Barhorst, and Vogt. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-84-07 adopted.

RES. NO. R-85-07

A resolution establishing one Piqua City Commission meeting for the month of July

Moved by Commissioner Barhorst, seconded by Commissioner Vogt, that Resolution No. R-85-07 be adopted. Voice vote, Aye: Hudson, Patrizio, Vogt, Terry, and Barhorst. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-85-07 adopted.

RES. NO. R-86-07

A Resolution of intent to vacate a public right-of-way

Moved by Commissioner Patrizio, seconded by Commissioner Barhorst, that Resolution No. R-86-07 be adopted. Voice vote, Aye: Barhorst, Terry, Vogt, Patrizio, and Hudson. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-86-07 adopted.

RES. NO. R-87-07

A Resolution awarding a contract to Walls Bros. Asphalt Co., Inc. for the 2007 Street Resurfacing Program

Commissioner Patrizio asked how many miles of streets would be paved this year?

Tom Zechman explained they city would do about seven and half miles of streets this summer.

Mayor Hudson asked who the bidders were on the Street Resurfacing project this time?

Tom Zechman stated there were only two bids that came in for this project, and they were from Walls Brothers and Barrett Paving.

Commissioner Terry asked if the bid amount fell within the budget amount allotted for this project?

Tom Zechman stated yes, the amount was within the budget limits.

Moved by Commissioner Terry, seconded by Commissioner Patrizio, that Resolution No. R-87-07 be adopted. Roll call, Aye: Hudson, Patrizio, Vogt, Barhorst, and Terry. Nay: None. Motion carried unanimously. Mayor Hudson then declared Resolution No. R-87-07 adopted.

OTHER

John Martin, Cleveland Street, President of the Shawnee Neighborhood Association, reminded citizens of the Neighborhood Garage Sale to be held in Shawnee on June 21 - 24, 2007.

Commissioner Vogt stated he would like to welcome Stacy Wall, the new Law Director, to the City of Piqua. Commissioner Vogt thanked former Law Director Grant Kerber for his service to the City of Piqua.

Commissioner Vogt reminded citizens of the upcoming Annual Car Show July 21, 2007 to be held at the Roadside Park on State Route 66.

Commissioner Vogt reminded citizens to continue to mow their grass even though we have not had any rain the "weeds" are still growing.

Commissioner Barhorst also welcomed Stacy Wall to the City of Piqua, and thanked Grant Kerber for his service to the City of Piqua.

Commissioner Barhorst reminded citizens of the activities planned in the downtown area Friday and Saturday June 22 & 23, 2007 for the City of Piqua's Bicentennial celebration.

Commissioner Patrizio welcomed Stacy Wall to the City of Piqua, and also thanked Grant Kerber for his service to the City of Piqua

Commissioner Patrizio thanked Chief Willcox and Officer Chris Lee for their support, stating he went on patrol with Officer Lee on Friday evening. Commissioner Patrizio reminded citizens to not drink and drive.

Commissioner Patrizio asked if it would be possible to cite the occupant of a residence instead of the landlord when the grass is not cut and nuisance letters have to be sent out.

City Manager Enderle stated he would look into the issuance of letters to occupants instead of landlords.

Commissioner Terry wished Grant Kerber well, and thanked Jim Eberly for his 30 years of service to the City of Piqua.

Commissioner Terry stated she is looking forward to working with the new Law Director Stacy Wall.

Commissioner Terry also reminded citizens of the Bicentennial activities downtown on June 22 & 23, 2007.

City Manager Enderle stated the City of Piqua will be giving a Police Lieutenant Exam and are in need of two citizens to sit on the interview panel. Citizens interested in serving on the panel should contact the City Manager's office, the Human Resource office for applications, and are also available on the city web site.

City Manager Enderle stated the 4th of July celebration would be held in the Hance Pavilion in Fountain Park on the 4th of July.

City Manager Enderle thanked Grant Kerber for his service to the City of Piqua, and appreciates all his time and efforts during his tenure with the City of Piqua.

Mayor Hudson stated he received a complaint about the traffic light by the mall on Route 36, stating the light is holding to long.

Tom Zechman, Public Works Director, stated he will check on it, but the light is ODOT's responsibility not the City of Piqua. Mr. Zechman also stated the ruts in the pavement by the mall will be filled in shortly.

Mayor Hudson inquired as to whether the City of Piqua has a noise ordinance regarding mowing of lawns before a certain hour in the morning.

Police Chief Willcox stated it would fall under the General Noise Ordinance and explained it.

Mayor Hudson thanked Larry Hamilton and his" PROD" group for their recognition of Diversity in the City of Piqua.

Mayor Hudson reminded citizens of the Bicentennial Parade on Saturday, June 23, 2007 at 2:00 P.M. stating the parade should last one-two hours.

Mayor Hudson welcomed new Law Director Stacy Wall, and thanked former Law Director Grant Kerber for his support.

Moved by Mayor Hudson, seconded by Commissioner Vogt, to adjourn from the Piqua City Commission meeting at 8:45 P.M. Voice vote, Aye: Vogt, Hudson, Patrizio, Terry, and Barhorst. Nay: None. Motion carried unanimously.
